When is a banana split not a banana split?

When it has no banana, obviously!

This landed on my table after I ordered from the photograph in the menu. The menu contained a delicious-looking banana split, complete with bananas.  As you can see, no bananas here.  When the question was raised the answer was “that’s for illustration purposes only”.

False advertising or creative licence?
